where we should file a complain to DOL(state ot federal). Every state also has separate DOL e.g. VA has DOLI( department of labor and industry) but federal also has DOL(department of labor) where we should file such complain?

Smerchas...Are you sure about what this? From what I remember, you have to be in the country when you apply for your AP...But there is no necessity that you need to be here when it is approved !
Technically, you can ask your attorney or the person who is living at the address where the AP document would be sent by the USCIS, and request them to forward the approved AP to your then current address...That way, you don't have to stay in the country while USCIS processes your application...
Ofcourse, the flip side is, if your AP is denied for any reason, you would have to go to the US consulate in wherever country you are and request the special admission letter...

Talk with hospitals in your area. May be $10K for the expense, if you didn't find any insurance to cover the pre-existing condition.
Spend it to get a US citizen child or save that money and make delivery happen in India.

We were successful in getting good media coverage with flower campaign. Our San Jose rally is getting good regional coverage. Yes, we haven't had the expected success with national media yet but we are gaining traction at an amazing pace.
This is not a big corporation with some PR dept. that is working with hundred of employees writing press releases et al. Volunteers like you and me have to take on that action item if you want to see results otherwise please continue on with your discussion
That is absolutely right, it is our job to write to reporters and call them, if we want good publicity. Please digg, write to reporters, do not just wait on the sidelines and see if we have gotten any coverage. We wont get any by just being on the forums discussing.
On a second note, gsc999 worked very hard organising the San Jose rally, and personally I saw a lot of dedication on his part and some other members. People came upto him and asked him to arrange another rally next week. He answered it very well. Why dont people take ownership and organise things on their own, rather than just giving out suggestions and expecting other people to do the tough work.

Guys who get RFE should keep a close watch on the receipt of the notice within 10 days from RFE issue date, if you don't receive it make sure you call them and get the RFE faxed or resent, the deadline to RFE respond wont be extended no matter what you do, this is based on my personal experience.
I got an RFE on May15'09, till date i have not received it, i did manage to get the RFE contents faxed to me after waiting 15 days but the medical form is lost somewhere, i am still working on responding to the RFE before June14'09 deadline.

3 deportations at POE (EWR) till date this yr .

Few facts that you need to get clear.
1) EB2 / EB3 is not based solely on your education/ experience. It depends on job requirements. If you have MS + 10 Yrs exp but the job is say Level 2 Data Analyst (SQL Developer) then it will not qualify for EB2.
2) You can file GC with same employer if he has a opening that requires MS qualification. You need to have qualification before labor is filed it does not matter if you get it while you were employed. This position should be different from your existing job.
If your employer has a job opening for which he cannot hire a citizen / GC holder then you guys can talk to immigration attorney to see if they can file a new labor for you.

I'm sorry -- I didn't follow. Can I use the H1-B which has been extended for 3 yrs since my 140 was approved already for a yr and the visa numbers weren't current? (I've already used up by 6 yrs)

You new employer can file for H-1B change of status for (upto) 3 years since you have I-140 approved and your PD is not current. The fact, that I-140 was applied by current (or ex) employer, does not matter.

Yes, you will be allowed to get one year extensions if your labor certification was filed before the start of your sixth year. But still you need to get clarfication from an attorney. I talked to one and she told me that since mine was filed RIR and passed the state stage and I was safe but if you filed in Non-RIR and no recruiting has been done then you may not be safe.

Out of the ones which are posted above, I used ECE recently for MBA admissions. They do not require attested copies from University. You need to fax your marksheets to them and pay the fees (I think $135). They may ask for original if fax is not clear, which was the case in my evaluation. I did not opted for Rush service and got the evaluation sent back to me in 4 weeks.

I wish my company attorney could understand the basic ENGLISH instructions. Worst part, still doesn't admit his mistake and keeps pointing to the receipt issued by USCIS.
Btw, I took Infopass appointment and went today to ask what should I do....given USCIS has issued receipt notice
The officer responded similar to my attorney's response, stating given that USCIS has issued receipt, they are working on my appl and I may not need to send the fee..BUT he admitted that the fee was required..
In short, still not sure what to do....
I think both your attorney and the Infopass official are right. The app fee is part of the initial evidence (documents) that are verified before the case is accepted. Since the receipt has been issued it seems the receipting agent has overlooked that the fee was required. But again, this is USCIS that we are talking about!!
Just my 2c and not a recommendation one way or the other!!

employers come up with vague reasons like we dont want to share tax telated info with many lawyers etc etec etc. Dont listen. Exceptions are always there but in general company hired lawyers are incompetant as they work on a whole sale basis and less accountable. And company hired lawyers are faithful to the employer and not you. In case of crisis they back whomever pay them. So guys shell ur money out and go with ur own lawyer. Or be smart enough to negotiate with ur employer that they pay the whole sale rate to ur lawyer and u come up with the difference for hiring a good lawyer

I claimed my parents as dependents. You only need ITIN and have to do paper filing first time....
I also have notarized passport, etc, but one of the tax consultants told me that the ITIN cannot be filed now, and when I file my 2008 returns in 2009, I need to apply for the ITIN along with the taxreturn and paperfile. Has anybody else applied ITIN before filing tax return ?
