The Technology section of the New York Times (http://bits.blogs.nytimes.com/2009/04/13/googles-immigration-fixer/?partner=rss&emc=rss) this week ran an article about an employee at Google whose job it is to "fix" problems Google employees have with the immigration system. The article is interesting, but what is really striking is the tone of the comments to the online article. There is a display of real anger at Google's hiring of foreign workers in this time of economic hardship - when so many U.S. citizens are looking for work. Read the article. What's your opinion?

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

Our friendly anti Jack has provided in the comments a couple of links to an intriguing story regarding Republican National Committee Chairman Michael Steele (currently embroiled in another scandal - this time involving strippers and GOP money - oy!). Steele has been one of the moderate voices in the GOP when it comes to immigration reform in the past and apparently he met with a pro-reform group called the Fair Immigration Reform Movement (FIRM). Accounts differ regarding whether Steele promised to work for immigration reform and, more specifically, help round up a second GOP Senator to sponsor the reform bill...

This shouldn't be a problem provided that she has the AP when she is leaving. AOS applicants don't need to be in the US while the AOS is pending, except to go to fingerprint appointments, interviews, etc. They must be in the US when the AOS is filed, and need to be careful to always have AP before leaving, but a 3-month gap should not be a problem.

The CBO report DREAM Act advocates have been touting reflects a net plus of $2.3 billion against the federal deficit. But that's the SENATE version that was analyzed. If the antis are right and 2,000,000 people will benefit from DREAM, the House version's new $2525 in filing fees will mean an additional $5 billion will be raised. Why, it would be fiscally irresponsible NOT to vote for DREAM!

Hi, I have my labor approved by Company A and I140 filed as soon as I got the labor. Before this I140 got approved I changed to Company B who filed for my labor and applied for I140 as soon as it got approved. My I140 with company B got approved and then the I140 with the old company A got approved 3 months later. Can I somehow get the old PD. Can some one who have been in similar situation or know some one in the similar situation answer this. I will be able to get a 2 year advance if this works out.

Need your input in a scenario of a friend of mine. My friend's wife is on H1 for the past 4 months and wants to transfer to an H4 visa under her husband. The wife's employer has not paid her any salary nor has he got her any project for the past 4-5 months, hence they are forced to make this decision. The h1 my friend's wife is only H1 approval papers and it is not stamped on her passport. The wife's employer is not willing to give her any papers of release or letter of leave without pay from her employment.
She needs to desperatly change her status to H4.....Suggestions needed??
Question=> Can my friend's wife go to India and apply for a H4 visa directly from the US Consulate in India? Without any papers related to the H1 visa??

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. Hi All,
I have applied I-485,I-765 and I-131(AP) for my wife as derivative when my priority date(March 26th 2006) became current on September 1st.
We recieved the Reciept notices for I-485,I-765 and I-131(AP) for my wife on September 30th.
My I-485 got approved on 11/05 .We didnot recieve FingerPrint notice still.
I would like to know how much time it generally takes for derivative I-485 approval .

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

July 2nd - Wife and I applied for 485\EAD\AP
The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.
Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room
I haven't got the receipt yet
Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)
Will special-handling speed up my Receipt OR EAD OR AP?

Hi Friends,
I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.
It'll really helpful to decide based on the folks replies. Thanks alot for the help.

My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.
The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?
